1. Acceptance of Terms

By installing and using SmartLang ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

SmartLang is an AI-powered translation application that helps Shopify merchants translate their store content, including:

  • Product titles, descriptions, and SEO fields
  • Collection information
  • Navigation menus
  • Metaobjects and custom content
  • Theme content

3. Account Requirements

To use SmartLang, you must:

  • Have an active Shopify store
  • Install the App through the Shopify App Store or Partner Dashboard
  • Authorize the required permissions for the App to function
  • Maintain accurate account information

4. Subscription and Billing

Plans

  • Free Plan: Limited features and translation quota
  • Basic Plan: Expanded features and quota
  • Pro Plan: Full features and higher quota

Billing

  • All billing is processed through Shopify's billing system
  • Subscriptions are billed monthly
  • You authorize Shopify to charge your payment method on file

Cancellation

  • You may cancel your subscription at any time
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial billing periods

Plan Changes

  • Upgrades take effect immediately
  • Downgrades take effect at the next billing period
  • Usage limits apply based on your current plan

5. Acceptable Use

You agree NOT to:

  • Use the App for any illegal purpose
  • Translate content that violates intellectual property rights
  • Attempt to reverse engineer or exploit the App
  • Interfere with the App's operation or infrastructure
  • Use the App to translate harmful, abusive, or inappropriate content
  • Exceed your plan's usage limits through automated means
  • Share your account access with unauthorized parties

6. Intellectual Property

Our Rights

  • SmartLang, including its code, design, and features, is owned by PixelEvolve AB
  • The App is protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, or distribute the App without permission

Your Rights

  • You retain ownership of your original content
  • You retain ownership of your translated content
  • You grant us a license to process your content for translation purposes

AI-Generated Translations

  • Translations are generated using AI technology
  • You are responsible for reviewing translations before publishing
  • We do not guarantee the accuracy of AI-generated translations

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF TRANSLATIONS.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Translations will be 100% accurate
  • The App will meet all your requirements
  • Defects will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for any loss of profits, data, or business opportunities
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim

This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

9. Indemnification

You agree to indemnify and hold harmless PixelEvolve AB, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you translate through the App

10. Translation Quality

AI Limitations

  • Translations are generated by AI and may contain errors
  • Nuances, idioms, and cultural context may not translate perfectly
  • Technical or specialized terminology may require manual review

Your Responsibility

  • Review all translations before publishing to your store
  • Use the glossary feature to protect brand names and terms
  • Edit translations as needed for accuracy and tone

11. Service Availability

Uptime

  • We strive for high availability but do not guarantee 100% uptime
  • Scheduled maintenance will be announced when possible
  • Emergency maintenance may occur without notice

Modifications

We reserve the right to:

  • Modify or discontinue features
  • Change pricing with 30 days notice
  • Update these Terms with notice to users

12. Termination

By You

  • You may uninstall the App at any time through Shopify Admin
  • Uninstallation terminates your subscription

By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Fail to pay subscription fees
  • Use the App in a way that harms us or other users

Effect of Termination

Upon termination:

  • Your access to the App ends immediately
  • Stored translations will be deleted per our retention policy
  • You remain liable for any outstanding fees

13. Dispute Resolution

Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

Jurisdiction

Any disputes shall be resolved in the courts of Sweden.

Informal Resolution

Before filing a formal dispute, please contact us at [email protected] to attempt informal resolution.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixelEvolve AB regarding the App.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights to a successor or affiliate.
